Acceptance of these Terms

Welcome to WeVisa. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Chen Radomsky, an authorized dealer in Israel operating as WeVisa ("we," "us," or "our"). These Terms govern your access to and use of our website and all related services (collectively, the "Services").

These Terms apply equally to all users, whether you are an individual using the Services for yourself (a "Private Client") or a business entity (e.g., travel agency) using the Services on behalf of your own customers or employees (a "Business Client").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. You acknowledge that this Agreement is a contract between you and WeVisa, even though it is not physically signed by you, and it governs your use of the Website and Services. If you do not agree with any part of these terms, you are prohibited from using our Services and must cease all activity immediately.

User Eligibility

The Services are available only to individuals who are at least 18 years of age. By using our Services, you represent and warrant that you meet this age requirement.

Disclaimer Regarding Third-Party Services

You acknowledge and agree that all Visa Application Assistance Services are provided solely by an independent third-party contractor. WeVisa's role is strictly that of a facilitator. We do not endorse, control, or make any warranties regarding the quality, accuracy, or legality of the services provided by the third party. Any dispute, claim, or issue arising from these services must be directed solely to the third-party provider. You irrevocably waive any claim against WeVisa with respect to such third-party services.

Billing, Payments, and Fees

General

You agree to pay all fees in accordance with the pricing and terms presented at the time of purchase. All sensitive data is transmitted over an SSL secured channel. We reserve the right to refuse or cancel any order at our discretion.

All fees paid to WeVisa are for the services we provide. These fees do not include any government application fees, which must be paid separately by you to the appropriate authorities.

Individual Clients

Payment for all services is required in advance.

Business Clients (Appointment Expediting)

At the beginning of each calendar month, business clients shall pay a 50% advance based on the forecasted number of appointments for that month. At the end of the month, the client will pay the remaining balance for the actual number of appointments successfully expedited, plus a 50% advance payment for the following month.

Refund and Cancellation Policy

Visa Application Assistance (Third-Party Service)

A refund, less a fixed administrative fee, is available only if cancellation is requested before any work has commenced by us or the third-party provider. No refunds will be issued once the process has started.

Appointment Expediting (Direct Service)

A full refund will be provided if we fail to secure an earlier appointment within your requested timeframe. A full refund is also available if you cancel the service before we have successfully secured a new appointment for you. Once an earlier appointment is secured and confirmed, no refund is possible for this service.

Client's Authorization for Account Access and Data Sharing

To provide our Services, it is necessary to access your personal account on the U.S. Embassy's official scheduling portal.

By purchasing and using any of our Services, you explicitly acknowledge, authorize, and instruct WeVisa and its designated third-party service providers (collectively, "the Service Providers") to:

  1. Use the login credentials (username and password) that you voluntarily provide.
  2. Perform all necessary actions on your behalf to deliver the specific service you purchased. This may include, but is not limited to, creating an account, completing application forms, paying fees, and scheduling or modifying appointments.
  3. View and process the sensitive personal information contained within your account as required to perform the service.

You specifically acknowledge and agree that this authorization includes the secure transmission of your personal information, including login credentials, from WeVisa to the relevant third-party provider when necessary for the provision of the Visa Application Assistance Service.

You represent and warrant that you are the legitimate owner of the account credentials provided and have the authority to grant this authorization. You understand that you are sharing this sensitive information at your own discretion and risk. We strongly recommend that you change your password after our services have been fully completed. The Service Providers will not be liable for any issues arising from your failure to do so.

Prohibited Uses

You are prohibited from using the Services: (a) for any unlawful purpose; (b) to violate any international or Israeli laws or regulations; (c) to infringe upon our intellectual property rights or those of others; (d) to harass, abuse, discriminate, or defame; (e) to submit false or misleading information; (f) to upload viruses or malicious code; or (g) to interfere with the security features of the Services. We reserve the right to terminate your access for violating any of these prohibitions.

Intellectual Property Rights

All content, logos, and trademarks on our website are the property of WeVisa or its licensors. These Terms do not grant you any right or license to use our intellectual property.

Accuracy of Information

From time to time, the Website may include typographical mistakes, inaccuracies, or missing details concerning product descriptions, pricing, availability, promotions, or offers. WeVisa reserves the right to correct such errors or omissions, and to update or modify information or even cancel orders if any part of the Website or Services is found to be inaccurate, without prior notice (including after an order has been submitted). WeVisa does not assume any obligation to revise, amend, or clarify information on the Website, including pricing details, unless required by law. Any stated update or refresh date on the Website should not be understood as confirmation that all Website or Service information has been revised or updated.

External Resources and Links

The Services may feature links to third-party websites and other external resources. WeVisa does not control and is not responsible for the content, products, or services offered by these third parties.

Providing a link does not constitute our sponsorship, approval, or partnership with the linked resource, unless expressly specified. For transparency, we may sometimes use affiliate links, meaning WeVisa may receive a commission if you purchase through our link.

You acknowledge and agree that you access these external resources at your own discretion and risk. You are solely responsible for reviewing and abiding by the terms and conditions of any third-party website you visit.

Disclaimer of Warranty

Your use of the Services is at your sole risk. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, nor do we make any warranty as to the results that may be obtained from the use of the Service.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall WeVisa (including its owner, employees, and agents) be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Services. Our total aggregate liability for any claim arising out of or relating to these services is limited to the amount you paid to us for the specific service in question.

Indemnification

You agree to indemnify and hold harmless WeVisa (and its owner, employees, and agents) from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of Israel. Any legal action or proceeding arising under these Terms will be brought exclusively in the competent courts located in Tel Aviv-Jaffa, Israel. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

Changes and Amendments

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this site and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

Severability

Should any term, clause, or provision of this Agreement be deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, such term, clause, or provision will be severed from the remaining parts of the Agreement. The remaining parts will continue to be in full force and effect, valid, and enforceable as if the severed portion had never been included. It is the intention of both parties that these Terms be enforced to the maximum extent permitted by applicable law.
